http://monadsrecords.com（以下当サイト）内のコンテンツを利用する際には、以下の利用規約に同意したものとします。
第1条 （定義）
各用語は、次のような意味を有するものとします。
「monadsrecords.com」とは、当サイトの運営元をさします。
利用者とは、当サイトを利用して商品を購入、または購入しようとする方をさします。
第2条 （商品の購入方法・契約の成立）
第1項 利用者は、購入商品を個人利用する場合に限り、下記の要領によって、当サイトで掲載商品を購入することができます。
当サイト(http://monadsrecords.com)にアクセスします。
当サイト内で購入希望する掲載商品を選択し、「この商品を買い物カゴに入れる」ボタンをクリックします。
購入商品の確認が表示されるので、「上記商品を購入する」ボタンをクリックします。
画面上のメッセージに従って、利用者データを入力します。
商品は利用者が入力された配送（お届け）方法により配達されます。
第2項 購入代金は、第4条の規定に従って支払われるものとします。
購入後、利用者は自らの費用負担により、本サービスを受けるために必要となる、コンピュータ、通信機器、電話回線その他の機器類を維持管理する必要があります。
第3項 また、「monadsrecords.com」は、その裁量により購入情報の確認が必要と判断した場合、利用者に対し、当サイト利用時に登録頂いた手段により購入意思・入力情報の確認を取ることができるものとします。
第4項 利用者の注文に対し、当社がE-Mailもしくは電話によって受注を回答した時点で、当該注文にかかる商品の売買契約が成立します。
第5項 ユーザーID・パスワードを用いて行われた注文は、理由の如何を問わず、有効な注文とみなします。
第6項 インターネット上の障害、その他当社の帰責事由なくして利用者の注文が受理されなかった場合、当社はその責任を負いません。
第3条 （商品の配達）
第1項 商品購入時に、利用者が選択した配達（お届け）方法に従って、「monadsrecords.com」は滞りなく商品が配達されるように商品の発送の手配を行う必要があります。但し、商品の品切れやその他の理由により、「monadsrecords.com」は配送予定日時を変更することがあります。その場合、「monadsrecords.com」は利用者へ第13条の方法によって連絡することとします。
第2項 第6条等の理由で、且つ適切な処置を行わなかった場合、意図する場所と違う場所に配達された場合でも、「monadsrecords.com」は一切責任を負わないものとします。
第3項 商品の発送が以下の理由で遅れることあることがあります。
利用者の都合で荷物を受け取れなかった場合
配送事情（中元・歳暮時期等）や、天災・交通事情・天候等が影響した場合
離島等、配達会社の事情で時間がかかる場合
第4項 商品の引渡しは、ご注文の際に指定されたお届け先に商品が配送されたことをもって完了したものとします。
第4条 （代金の支払い）
第1項 掲載商品を購入した場合、所定の代金を購入時に指定した方法でお支払いください。
第2項 代金が未払いで、且つ購入日から1週間過ぎた場合は、利用者に商品購入意思がないものと見なし、その利用者の購入権利を「monadsrecords.com」は通知なしに解除することができることとします。
第3項 第16条等の理由により、購入後、支払前に購入商品の価格が改正された場合でも、支払い代金は購入時に表示される「最終確認画面」の「合計請求金額」を支払うものとします。
＜送料について＞
クレジットカード・PayPal決済にて掲載商品を購入した場合、商品代金の他、送料がかかります。
12,000円(税込)以上のお買い上げのお客様は、郵便局：定形外郵便物 (簡易書留付)、またはゆうパックの送料を無料とさせて頂きます。
郵便局：定形外郵便物は追跡伝票番号や盗難破損等の保険、保証は付属しておりません。未着、紛失、破損、盗難等に対する対応は出来かねますので予めご了承下さい。通常の郵便物と同等扱いで到着日や時間帯指定等も出来ません。なお、簡易書留以外は土曜日・日曜日・休日での配達は行なっておりません
『受領印を必要としない為、荷物をポストに投函させていただきます。ポストがない場合、ポストが小さすぎて投函できなかった場合チャイムを鳴らしお客様へ手渡しとなりますが、お客様が不在の場合は不在票を残し商品は持ち帰らせていただきます。但し宅配BOXがあれば宅配BOXに入れ不在票を残します。ご不在のため持ち戻った郵便物は、お客さまが希望される日『土曜日・日曜日・休日も含む』または時間帯に再配達が可能です。』
郵便局：定形外郵便物 (簡易書留付)は追跡伝票番号や盗難破損等の保険が付きます。時間指定は出来ませんが、お客様の受領印が必要になります。ご不在のため持ち戻った商品は、お客さまが希望される日または時間帯に再配達が可能です。

定形外郵便物 (追跡・保障無し)の場合の送料：
500gまで - 510円
1kgまで - 710円
2kgまで - 1,040円
4kgまで - 1,350円
最大4kgまでの対応となります。
簡易書留（定形外郵便物）の場合の送料：
500gまで - 830円
1kgまで - 1,030円
2kgまで - 1,360円
4kgまで - 1,670円
最大4kgまでの対応となります。
第5条 （購入商品の注文キャンセル）
購入した商品を商品発送前であり、且つ3日以内に電子メールで「monadsrecords.com」宛てにその旨を連絡することで対応するものとします。3日以上経過した場合、または商品発送済みのキャンセルは受付けないものとします。その場合、利用者は第4条に従って、代金を支払うものとします。
第6条 （返品・交換）
第1項 到着した商品の返品・交換を行う場合は、商品を使用せず、商品到着後3日以内に「monadsrecords.com」が指定する電子メールアドレスにその旨を連絡する必要があります。この処置を行わなかった場合の返品・交換は一切の受け付けを致しません。
第2項 利用者は購入商品を以下の場合に限り商品の返品・交換ができるものとします。
利用者が返品依頼をした場合でも、購入商品と同等商品がある場合は交換対応のみ受け付けるものとします。
購入した商品と、到着した商品が違う場合
サイトで告知していない傷、不備等があった場合
その他、当社が返品、交換の必要があると認めた場合
第3項 但し、上記該当の場合でも、下記に該当する場合は返品・交換の対象となりません。
商品を使用した痕跡があった場合
返品、交換の適切な処置をとらなかった場合
第4項 返品、交換依頼を利用者が申請し、「monadsrecords.com」が該当商品の再鑑定・検品が必要と判断した場合、利用者はすみやかに指定の方法に従って、商品を「monadsrecords.com」宛に発送してください。
商品確認後、交換の必要があると「monadsrecords.com」が判断した場合は同等商品と交換し発送、同等商品の在庫がなかった場合は、購入代金の払い戻し処理を行います。交換規定外商品の場合は、同商品を利用者宛返送するものとします。
第5項 返品、交換が認められた場合、利用者は返品方法の通知後、1週間以内に商品を「monadsrecords.com」宛に発送することで、対象商品の返品・交換を受けることができます。返品、交換が認められた場合でも1週間を過ぎての交換は一切受け付けないものとします。何らかの事情で対応できない場合、利用者はすみやかに指定の方法に従ってその旨を連絡をするものとします。
第6項 正規の手続きを取らずに、商品の返品・交換を依頼した場合（連絡をせずに商品を返送した場合、返品該当商品でない商品を返品した場合等）、「monadsrecords.com」は同商品を利用者に対し、再発送し発送費用を利用者に対し請求できるものとします。
第7条 （紛失のリスクについて）
「monadsrecords.com」にて購入されたすべての商品について、商品を利用者がご指定になられた配送会社に引き渡した時点で、その商品に関する紛失のリスクと権利は利用者に移ります。
第8条 （利用者の個人情報の取扱い）
第1項 「monadsrecords.com」は、利用者がサイト内で入力・提供した個人情報の重要性を十分認識した上で、個人情報保護法等の関係法令を遵守し、個人情報の安全で正確な管理に努め、下記の場合を除き、第三者に開示又は漏洩致しません。
お客様が希望される当社サービスを当社がご提供すること
お客様が売買された商品に関連する商品情報、サービスまたはイベントやキャンペーン等のご案内
当社が扱う商品や情報に関するアンケートの実施
第2項 個人情報の第三者への提供の制限
お客様の同意がある場合
お客様が希望されるサービスを行うため当社が指定会社に提供する場合
法令や法的機関の要請に基づく場合
第3項 個人情報の開示・訂正・利用停止の請求手続き
開示等のご希望は電話、郵便またはメールにてお受けいたします。
開示等に必要な申込み用紙と本人確認に必要な公的書類の写しをご郵送いただきます。
開示の場合に限り、手数料として郵便切手200円を同封していただきます。
原則として申込み用紙到着後10日以内に郵便にて回答させていただきます。
該当する情報が存在しない場合はもちろん、業務の遂行上支障があると判断した場合は開示等をお断りすることがあります。

第9条 （コンピュータ、個人情報の管理）
第1項 「monadsrecords.com」では、コンピュータ、メールアドレスや住所等の個人情報の不正利用等に関して、一切責任を負いません。
第2項 利用者は、下記のいずれかの事由が生じた場合には、その旨を直ちに「monadsrecords.com」に通知し、処置を講じなければなりません。
住所や名前、電子メール、クレジットカード等の個人情報が不正利用されたとき
商品注文の際の入力データに誤りがあった場合
プロバイダーとの契約解除等の理由により、商品注文の際に入力したデータに変更があった場合
第10条 （当サイトの保守・点検）
利用者は、当サイトの保守・点検のため、又は、天災・通信回線の故障などのやむをえない事情により、当サイトが一時的に利用できなくなることを了承するものとします。
また、「monadsrecords.com」は、当サイトのシステムの回帰不能な障害が生じた場合、その他相当の理由がある場合には、予告なくサービスの提供を中止することができるものとします。
第11条 （禁止事項）
第1項 利用者は下記の行為を行ってはなりません。
当サイトが指定した方法以外で、当サイトを利用すること
当サイトの商標権等の財産的又は人格的な権利を侵害、侵害する恐れのある行為を行うこと
当サイトのコンテンツ（文章、グラフィック等）の無断転載・複製を行うこと
当サイトを利用して、法令に反する行為を行うこと
本規約に違反する行為を行うこと
以上を違反した場合には、「monadsrecords.com」は当該利用者に対して、「monadsrecords.com」に生じた一切の損害、損失及び費用の賠償を求めることができるものとします。
第2項 「monadsrecords.com」では、下記いずれかの事由が生じた場合には、その裁量により当該利用者に関して、商品の購入等、当サイトの利用を停止することができるものとします。
代金の支払いを怠った場合
本規約の規定に違反した場合
入力事項に虚偽の届け出をしたことが判明した場合
「monadsrecords.com」または、他の利用者の利害を害する行為を行った場合
利用者として不適当であると「monadsrecords.com」が判断した場合
商用利用など、個人使用目的以外のために当サイトの商品を購入したと判断された場合
利用資格を停止された利用者は、今後一切当サイトを利用できないものとします。
第12条 （免責）
第1項 当サイトを利用して、利用者が被った損害（ハードウエア、ソフトウエアの障害、不具合、誤動作 / 所有PCの個人管理を怠ったために生じた損害等）について「monadsrecords.com」では一切責任を負いません。
第2項 サービスの向上のために当サイトは、当サイトとは一切関係のない外部企業・個人のサイトを紹介する場合があります。そのサイトに掲載されている情報の内容を利用して被った損害に関して、「monadsrecords.com」では一切責任を持ちません。
第13条 （通知）
第1項 利用者に対する通知は、利用者が「monadsrecords.com」に届け出た電子メールアドレスに電子メールを送信することによって行うものとし、発信時に通知の効果が生じるものとします。利用者が登録電子メールアドレスの変更の届け出を怠ったなど、発信時に利用者の電子メールアドレスが一時的に利用できなかったなどの理由で電子メールが到着しなかった場合でも、通知は有効であるものとします。
第2項 商品の配達、代金に対する問題など緊急を要すると「monadsrecords.com」が判断した場合に限り、当該利用者に対し当サイト利用時に登録頂いた手段を利用する場合があります。
第3項 利用者の当サイトに対する通知は、指定された場合を除き、電子メールによって行うものとします。
第14条 （登録基準）
16才未満の場合、保護者了承の上、保護者氏名で注文受付いたします。
第15条 （利用規約の変更）
「monadsrecords.com」は、利用者に対して、その旨通知することなく、本利用規約を変更することができるものとします。
第16条 （掲載商品の価格改正・変更・中止）
当サイトは「monadsrecords.com」独自の判断により利用者に予告なく、当サイト内の掲載商品の販売の中止、価格の改正、その他のサービスの提供を変更・中止することができるものとします。
第17条 （準拠法）
「monadsrecords.com」の利用に関する全ての契約については、日本国法及び当社の全ての規約等や各サービス会社の規約等が適用されます。
第18条 （紛争および裁判管轄）
当サイトの内容に関して利用者と当社の間で紛争が発生した場合には、当事者間で協議の上解決を図り、解決に至ることができない場合においては、東京地方裁判所を、第一審の専属管轄裁判所とします。
